Ice cream company, Ben & Jerrys, have sued a porn company for creating an X-rated video series called “Ben & Cherry’s”, which they say smears their wholesome reputation.
Lawyers for the popular ice cream brand say the sale of pornographic DVDs under the parodic name creates an association with filthy sex and tarnishes the name of Ben & Jerry’s Homemade Holdings Inc.
The film company released a string of films based on the well-known flavours – and even used images seen on Ben & Jerry’s ice cream tubs on their DVD covers.
Some of the X-rated names include “Boston Cream Thigh,” ‘’New York Fat & Chunky” and “Peanut Butter D-Cup”, parodies of Ben & Jerry’s flavours “Boston Cream Pie,” ‘’New York Super Fudge Chunk” and “Peanut Butter Cup”.
The lawsuit by the Vermont-based company said the films would likely cause “confusion, mistake or deception” regarding the company’s trademarks.
For nearly 35 years, Ben & Jerry’s has produced and sold ice cream in 300 shops in the US and 150 internationally.
Ben & Jerry’s has previously used some racy names for its ice cream flavors, including Schweddy Balls and Karamel Sutra.
